Successful Appellant in Lomax v Lomax in the Court of Appeal

The Court of Appeal today held that litigants can be compelled to attend an Early Neutral Evaluation without their consent (CPR 3.1(2)(m)), overruling the recent decision of Parker J in Lomax v Lomax. Halsey v Milton Keynes General NHS Trust distinguished and the Court Guides disapproved. Christopher appeared for the successful Appellant instructed by Maria Lonergan of KBL Solicitors.
