HPII v Marlborough Developments Limited & Ors [2024]

Success at a 3-day trial for HPII, where claims were brought under s.423 IA 1986 and the Marex tort to unwind an anti-enforcement scheme. HPII also succeeded in setting aside a £850m default judgment as a party “directly affected” by it, and having associated proceedings struck out as a “paradigm example of abusive proceedings”.
