The Big Freeze: Obtaining Worldwide Freezing Injunctions
Madeline will recap the test to be applied by the court in considering whether to grant a worldwide freezing order. The talk will examine in more detail the “good arguable case” element of the test in light of the Court of Appeal’s decision in Dos Santos v Unitel SA [2024] EWCA Civ 1109. Finally, she will briefly discuss issues relating to dissipation of assets which arose in one of my cases.
Finding without fishing: obtaining disclosure in fraud claims
Robert will be covering why and how disclosure is particularly useful in fraud claims, the toolkit to obtain disclosure orders, pitfalls and points to note, recent developments and a couple of case studies from his own practice.
