Matthew Moriarty – ‘Income Payments Orders – an underused tool in bankruptcy?’

Much of the focus on realisations in bankruptcies is on the bankrupt’s existing assets, but section 310 Insolvency Act 1986 allows a trustee to claim some of the bankrupt’s income for the benefit of creditors. Despite some recent high profile income payments orders, these remain a relatively uncommon tool in bankruptcies. Should they be used more, and how can we avoid the challenges that may arise in doing so?
